Commercial Activities on Public Land Application

We support a range of commercial activities on public land to activate our city. Commercial activities contribute to the city’s quality of life and community participation to achieve our vision of a thriving, resilient, liveable city.

An activity is commercial if it involves the exchange of goods or services for a fee, or promotes a business activity or entity, such as:

  • Personal training and fitness activities
  • Mobile food trucks, drink vans and stalls
  • Animal training and services
  • Leisure activities, events and tours and
  • Recreational equipment hire.

When you need consent

Consent from AlburyCity is required to operate a commercial activity on public land. Under the Commercial Activities on Public Land Policy, we regulate commercial activities to optimise the benefit to residents and visitors and to safeguard public health, safety and amenity of patrons and the community on public land.

It is important your business or organisation has the correct permits and consent to operate lawfully. If you operate a commercial activity on public land without consent, enforcement action may be taken.

We aim for commercial activities on public land to meet the following objectives:

  • Be in a location that enhances the vibrancy and the social fabric of a particular public area or neighbourhood.
  • Be a natural extension of the city - innovative and distinctive designs, product offering and infrastructure is required.
  • Be designed to create an attractive, comfortable and safe ambience for the public and should not compromise the public amenity.
  • Be engaging and diverse in nature. The ability to attract and engage people, particularly visitors to the city, can enhance the vitality of a public space and create a sense of interest and curiosity.
  • Be socially, environmentally and economically responsible.
  • Considered suitable and acceptable with regard to public appeal and amenity.

To undertake Commercial activities on public land you are required to familiarise yourself with the following our policies and guidelines prior to lodging an application to ensure that your application has all required information:

If you are thinking of starting a new business venture, this of course comes with potential risks. We encourage you to seek professional advice and explore all elements of your proposed operation prior to submitting an application.

We are not able to assist with advice on potential financial implications, viability or feasibility so it’s important that applicants invest their time in developing a comprehensive business plan which also aligns with the Commercial Activities on Public Land policy and guiding principles.
